Terms of Service

These Terms of Service govern your use of bsdbakehouse.com and any purchase made from Boruch’s Sourdough Bakehouse.

Throughout these Terms, “Boruch’s Sourdough Bakehouse,” “we,” “us,” and “our” refer to:

By visiting our website, creating an account, placing an order, or purchasing a product, you agree to these Terms of Service and to our applicable policies, including our Refund and Return Policy, Shipping and Delivery Policy, and Privacy Policy.

Do not use the website or place an order if you do not agree to these Terms.

1. Eligibility and Website Use

You must be at least the age of majority in your state of residence to place an order through this website, or you must have the permission and supervision of a parent or legal guardian.

You may use our website only for lawful personal or commercial purchasing purposes.

You may not:

  • Use the website for fraudulent, unlawful, or abusive purposes.
  • Submit false billing, payment, contact, or delivery information.
  • Attempt to interfere with the website’s security or operation.
  • Copy, reproduce, scrape, or commercially exploit website content without authorization.

2. Product Information

We make reasonable efforts to accurately describe our products, including their ingredients, quantities, approximate weights, dimensions, photographs, availability, and pricing.

Because our products are handmade and baked in small batches, natural variations may occur in:

  • Shape
  • Size
  • Weight
  • Color
  • Texture
  • Rise
  • Crumb structure
  • Decoration
  • Appearance

Product photographs are representative. A handmade product may not appear exactly identical to the photograph shown online.

Weights and dimensions described as “approximately,” “average,” or “about” are reasonable estimates and may vary slightly.

3. Ingredients and Recipe Changes

Product ingredients are listed on the product page, packaging, or label when applicable.

We may make minor recipe, sourcing, or ingredient changes when necessary because of availability, seasonality, supplier changes, or production requirements. We will not knowingly make a material substitution involving a declared allergen without updating the applicable product information or obtaining the customer’s consent when appropriate.

Customers should review the current product description, ingredients, and allergen information before every purchase, even if they have ordered the product previously.

4. Allergies and Dietary Requirements

Our facility may handle wheat, gluten, tree nuts, sesame, eggs, dairy, soy, and other food allergens, depending on the products being prepared.

Although we use reasonable handling and cleaning practices, we cannot guarantee that any product is completely free from cross-contact with an allergen unless we expressly provide that guarantee in writing.

Customers with serious allergies, celiac disease, food sensitivities, medical dietary restrictions, or other health concerns should contact us before ordering and consult an appropriate healthcare professional when necessary.

The customer is responsible for reviewing:

  • Ingredient lists
  • Allergen statements
  • Product labels
  • Storage instructions
  • Dietary descriptions

Terms such as “vegan,” “dairy-free,” “refined sugar-free,” “organic,” “kosher,” or similar descriptions apply only when expressly stated on the current product page or product label. No certification or dietary status should be inferred when it is not specifically stated.

5. Nutrition and Health Information

Information on our website concerning ingredients, fermentation, grains, nutrition, digestion, or general wellness is provided for general educational and product-description purposes.

It is not individualized medical advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Individual experiences with food products vary. Customers with diabetes, allergies, digestive conditions, metabolic conditions, or other health concerns should consult a qualified healthcare professional before making dietary decisions.

6. Prices and Taxes

Prices are displayed in United States dollars unless otherwise stated.

We may change prices, product availability, promotions, shipping rates, and product descriptions at any time before an order is accepted.

Applicable taxes, delivery charges, shipping charges, and other disclosed fees will be shown during checkout when required.

A pricing or typographical error does not require us to fulfill an order at an obviously incorrect price. If an error affects an order, we may contact the customer for approval of the corrected amount or cancel the affected item and issue a refund.

7. Orders and Acceptance

Submitting an order does not guarantee acceptance.

An order is accepted when we confirm that we can prepare and fulfill it. We reserve the right to reject, limit, or cancel an order for reasonable purposes, including:

  • Product unavailability
  • Production limitations
  • Incorrect pricing
  • Suspected fraud
  • Payment problems
  • Delivery restrictions
  • An incomplete or inaccurate address
  • Orders that violate applicable law
  • Orders that we cannot safely or reasonably fulfill

If we cancel a paid order before fulfillment, we will refund the amount paid for the canceled products.

We may limit quantities purchased by one customer, household, account, business, payment method, or delivery address.

8. Payment

Customers agree to provide accurate and complete billing and payment information.

By submitting payment information, the customer represents that they are authorized to use the selected payment method and authorizes us and our payment processors to charge the total amount shown at checkout.

We do not guarantee that a payment provider will approve a transaction. Orders may be delayed or canceled when payment authorization fails or requires additional verification.

9. Order Changes and Cancellations

Contact us as soon as possible to request an order change or cancellation.

We may approve a change or cancellation only when production, preparation, purchasing, or fulfillment has not already begun.

Because products are made fresh and may be prepared specifically for a customer, cancellation may no longer be available after:

  • Ingredients have been purchased specifically for the order.
  • Dough or other preparation has begun.
  • Products have been baked.
  • Packaging has begun.
  • A shipping label has been created.
  • The order has been transferred to a carrier.

Custom orders, catering orders, wholesale orders, large orders, and special-event orders may be subject to separate cancellation terms communicated before acceptance.

10. Fresh and Perishable Products

Our products are freshly prepared and may have a limited shelf life.

Customers are responsible for:

  • Promptly receiving delivered packages.
  • Following storage instructions.
  • Refrigerating or freezing products when instructed.
  • Protecting products from excessive heat, moisture, sunlight, pests, and contamination.
  • Using reasonable judgment before consuming a product.

We are not responsible for deterioration caused by improper storage, delayed opening, failure to follow instructions, or handling after delivery or pickup.

Do not consume a product that appears contaminated, spoiled, tampered with, or unsafe. Contact us promptly with photographs and the order number.

11. Shipping

Shipping is generally most suitable for sturdy products such as breads, challah, bagels, crackers, and other products identified as appropriate for shipment.

Delivery dates and transit times are estimates unless expressly guaranteed in writing.

Once a properly addressed and reasonably packaged order is transferred to the shipping carrier, we do not control the carrier’s transportation or delivery operations. We are not responsible for delays caused solely by:

  • USPS, UPS, FedEx, or another carrier
  • Weather
  • Holidays
  • Transportation interruptions
  • High shipping volume
  • Governmental actions
  • Natural disasters
  • Incorrect carrier routing
  • Circumstances outside our reasonable control

We will make reasonable efforts to assist customers with tracking information, carrier inquiries, and available claims.

Additional shipping terms are contained in our Shipping and Delivery Policy, which is incorporated into these Terms.

12. Fragile Products

Cookies, muffins, pastries, cakes, and similar baked goods may crack, crumble, flatten, shift, or become cosmetically damaged during normal transportation.

When a customer chooses to ship a product identified as fragile, the customer acknowledges the ordinary risk of shipping-related cosmetic damage.

Minor or moderate cosmetic damage does not automatically qualify for a refund or replacement when the product remains safe and suitable for consumption.

This limitation does not apply when:

  • We shipped the wrong product.
  • We omitted an item.
  • We materially failed to package the order with reasonable care.
  • The product was defective or unsafe when shipped.
  • Applicable law requires another remedy.

Local pickup or delivery is recommended for fragile, decorated, or event-specific products.

13. Shipping Addresses and Delivery

Customers are responsible for providing a complete and accurate shipping or delivery address.

We are not responsible for delays, failed deliveries, returned packages, or lost packages caused by:

  • An incorrect address supplied by the customer.
  • A missing apartment or unit number.
  • Recipient unavailability.
  • Refusal of delivery.
  • Failure to retrieve a package.
  • Inaccurate contact information.

Because products are perishable, an order returned to us may not be suitable for reshipment. Additional product and shipping charges may apply.

When tracking confirms delivery, customers should promptly check entrances, mail areas, neighbors, household members, building personnel, and any carrier-designated safe location.

14. Local Pickup

Customers selecting pickup are responsible for collecting the order during the agreed pickup period.

Orders prepared but not collected are generally not refundable because the products were made specifically for the customer and may be perishable.

Customers should contact us promptly when an emergency or unavoidable circumstance prevents pickup. Any accommodation is determined individually and is not guaranteed.

15. Returns, Refunds, and Problems With Orders

Because food products are perishable and cannot safely be restocked or resold, we do not accept ordinary physical returns of food products.

Customers must contact us within 48 hours after delivery or pickup regarding:

  • Incorrect products
  • Missing products
  • Significant damage
  • Spoilage upon receipt
  • Material quality problems
  • Suspected safety issues

The customer may be required to provide photographs of the product, packaging, shipping label, and damage.

Depending on the circumstances, we may provide a replacement, store credit, partial refund, full refund, or assistance with a carrier claim.

All requests are governed by our Refund and Return Policy, which is incorporated into these Terms.

16. Wholesale, Catering, Custom, and Large Orders

Wholesale, catering, custom, subscription, membership, and large-volume orders may be governed by a separate written proposal, invoice, agreement, or order confirmation.

When a separate written agreement conflicts with these general Terms, the specific written agreement controls for that particular order.

Deposits may be nonrefundable after ingredients are purchased, production time is reserved, or preparation begins, provided that the applicable deposit and cancellation terms are disclosed before payment.

Any membership, subscription, loyalty, or customer club is a purchasing and customer-benefit program only. It remains subject to applicable law, food-safety requirements, licensing requirements, and these Terms.

17. Promotions and Discount Codes

Promotions and discount codes:

  • May have expiration dates.
  • May be limited to particular products or customers.
  • May not be combined unless expressly permitted.
  • Have no cash value.
  • May be modified or canceled before use.
  • May be refused when obtained or used fraudulently.

A discount applies only to eligible products and ordinarily does not apply to taxes, delivery fees, or shipping charges unless expressly stated.

18. Gift Cards and Store Credit

Gift cards and store credit may be subject to separate terms displayed when issued.

They may not be redeemed for cash except where required by law. Lost, stolen, or improperly used codes may not be replaceable unless we can reasonably verify ownership and the remaining balance.

19. Reviews, Photographs, and Customer Content

Customers may submit reviews, comments, suggestions, photographs, or other content.

By voluntarily submitting content to us or publicly tagging our business, the customer represents that:

  • They have the right to submit the content.
  • The content is truthful to the best of their knowledge.
  • The content does not violate another person’s rights.
  • The content is not unlawful, threatening, defamatory, or fraudulent.

When content is submitted directly for promotional use, the customer grants us a nonexclusive, royalty-free right to display, reproduce, and share it in connection with our business, unless otherwise agreed in writing.

We may remove website content that is unlawful, abusive, irrelevant, fraudulent, or violates these Terms. We do not require positive reviews and do not prohibit honest customer opinions.

20. Intellectual Property

The website and its content—including our business name, logos, product photographs, original descriptions, graphics, packaging designs, recipes disclosed as proprietary materials, and other original content—are owned by us or used with permission.

Customers may not reproduce, publish, sell, modify, distribute, or commercially exploit this content without written permission.

Limited personal use of the website for shopping and reviewing product information is permitted.

21. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, social-media platforms, mapping services, and other websites.

Third-party services operate under their own terms and privacy policies. We are not responsible for the content, security, availability, conduct, or policies of an independent third party.

The inclusion of a link does not necessarily constitute an endorsement.

22. Website Availability and Errors

We try to keep the website available and accurate, but we do not guarantee that it will always operate without interruption, delay, technical error, or security incident.

We may correct errors, update content, suspend features, perform maintenance, or discontinue part of the website without prior notice.

We are not responsible for a customer’s internet connection, device, browser, email filter, or other technology outside our control.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website is provided on an “as available” basis.

We do not guarantee that the website will be uninterrupted or entirely error-free.

Products are provided subject to the descriptions, representations, and remedies expressly stated on the product page, packaging, these Terms, and applicable law.

Nothing in these Terms excludes or limits any warranty, consumer protection, food-safety obligation, or legal right that cannot lawfully be excluded or limited.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Boruch’s Sourdough Bakehouse and POLIATZKY BAKEHOUSE LLC will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from:

  • An ordinary carrier delay outside our control.
  • Cosmetic damage to a product clearly identified as fragile.
  • Customer-provided address errors.
  • Improper storage or handling after delivery.
  • Unauthorized or unlawful use of the website.
  • Temporary website unavailability.

For an ordinary claim involving a particular order, our maximum liability will not exceed the amount paid for the affected product or order, except where applicable law requires otherwise.

This limitation does not apply to:

  • Fraud or intentional misconduct.
  • Gross negligence.
  • Liability that cannot legally be limited.
  • Personal injury caused by legally actionable conduct.
  • A product that was adulterated, unsafe, or materially defective when supplied.
  • Any rights or remedies protected by applicable consumer law.

25. Indemnification

To the extent permitted by law, a user agrees to be responsible for reasonable losses or expenses caused by that user’s unlawful use of the website, fraudulent conduct, infringement of another person’s rights, or material violation of these Terms.

This provision does not require a customer to indemnify us for our own negligence, misconduct, or violation of law.

26. Privacy

Personal information submitted through the website is handled according to our Privacy Policy.

Payment information may be processed directly by Shopify or another payment provider. Their handling of information is also governed by their own terms and privacy practices.

27. Governing Law

These Terms and purchases made through the website are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Subject to any consumer right that requires another location or forum, disputes relating to these Terms or an order may be brought in a court with proper jurisdiction located in Rockland County, New York.

Nothing in this section prevents either party from using an applicable small-claims court.

28. Severability

If a court determines that one provision of these Terms is unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

29. No Waiver

Our failure to enforce a provision on one occasion does not waive our right to enforce that provision later.

A waiver is effective only when made clearly and in writing by an authorized representative.

30. Entire Agreement

These Terms, together with our product descriptions, Refund and Return Policy, Shipping and Delivery Policy, Privacy Policy, and any applicable written order agreement, constitute the agreement between the customer and us concerning use of the website and purchases.

31. Changes to These Terms

We may update these Terms to reflect changes in our business, website, products, policies, or legal obligations.

The updated version will be posted on this page with a revised effective date. Changes apply prospectively and do not retroactively change the material terms of an already accepted order unless required by law or agreed to by the customer.
